If I'm drunk/high perhaps crazy speeding and have a history of said badness then perhaps you could get a civil case to fall your way.
But solely based on being over a
manufacturers weight (not even my licensed weight). Not a chance in the world.
The manufactures weight has no bearing, licensed weight is the legal point of concern. Beyond weight the concern is how the vehicle is being operated (safety).
