FunTime RV - Cleburne Texas
Fun Time RV who claims to be "the Largest Montana RV Dealer in the Nation Since the Montana Brand Started" http://www.funtimerv.com/brands/montana-rv.aspx was foreclosed on by their finance company this morning.
Go ahead ask me how I know ...... went down to pick up my trailer from service after getting the last of the Warranty Items taken care of and now my trailer is being held hostage. I am being told they will start releasing customers property back to customers mid week, next week after they confirm ownership. I hope so, we leave for California in less than 3 weeks!
Anyrate if anybody else from here in the Dallas/Fort Worth area bought your trailer there or currently have your trailer there for service ...... well.
I do have the number of the finance company that foreclosed on them. PM me and I will pass along the info if you need it.

Thanks! Good thing is Texas is a strong property rights state. I can prove that they have my property and no legal authority to continue to hold. Worse case, I file a stolen property report.
My fear is damage or theft the longer it sits on Fun Time Lot. Because it is going to be real hard to hold anybody accountable for damage or theft. The bank will say it is Fun Times fault and then Fun Time is broke and say it is the banks fault. I will have no way of proving when it happened.

The banks did that to two local dealerships awhile back, one of which was a Montana line carrier. Gal at the parts counter told me that the bank showed up mid-day on a Friday and called due around $14 million by the end of banking hours of the same day. All of the RV's were gone from the lot by the end of Sunday and sold at auction.
My big concern, if I were you, would be to make sure that your 5er is not towed off of the property and handed over to an inventory wholesaler who will auction everything off for pennies on the dollar to some other dealer. Don't sit on your hands and wait it out, get out there and be very vocal with whoever is in charge of the site right now. Bring some kind of proof that the 5er is yours, with VIN#, sales contract, loan papers, etc. Demand that your property be turned over to you. Make a written claim of ownership with copies of your proof and get it to whoever is in charge of the operation. If it is sold at auction, sure, you may get it back, ....eventually.
I hope this all goes well for you, and in a timely fashion, but don't assume that there is someone out there looking after your best interests for you, especially the bean counters at some bank.

I know nobody but myself is looking out for my best interest in this deal.
I have title in hand and can prove ownership. Basically I will give them a few business days and then if I am getting nowhere I will call and file a police report that my property has been stolen. Texas is a big property rights state. The good thing is the PDI is separate from the Service department. Two completely different parts of a huge lot. My trailer is/was in service so nowhere near PDI or new trailers.
Trying to keep positive thoughts but it is kinda tough. Hopefully I will start getting answers on Monday.

I'm with KTManiac. My brother used to work for a receivership firm and was put in charge of a failed business. His job was to squeeze every dollar out of it and resist paying anybody any money or giving people their property. It made him sick to do this and he eventually resigned. I second the motion that you sqeak REALLY LOUD every day.

RickW, I not only agree with KTManiac but I think there must be a way to either take possession of your Monty or at the very least get into the lot and take pixs of your unit (hopefully that nothing is damaged at this time)in case something is damaged later you will have some documentation that it was done while in possession of the receivers.
I would think that a trip to the Johnson county courthouse or sheriff's office would produce some info on your rights. If nothing else hire an attorney to tell you your rights and/or file the papers you will need. You may be able to present his bill to the receivers.

Spent a good part of the day on the phone. Most places I called, I was not the first. I have spoke with the Sheriffs Office (incident report taken), District Clerks office, First Financial of Cleburne & GE Capitol. I have also been been working closely with the lender that currently holds my note (Almost paid it off last month. Glad I decided to wait a month. They have been very helpful).
Any rate they have all been helpful except First Financial of Cleburne. According to my lender starting tomorrow they will start working on releasing non-bank owned property (not owned by First Financial). According to GE Capitol they want all non-bank owned property off the lot ASAP.
So hopefully tomorrow will be more productive. Hopefully by this time tomorrow I will either have the trailer or at least an date/time that they will release it.
Keeping my fingers crossed.

Received a Call from First Financial of Cleburne this morning. She gave me a name and number (Funtime) to contact. They are suppose to start release non-bank owned property. You just have to get in line over the phone for date/time to pick up you unit. She was also grateful that I have been understanding and polite thru this process.
The phones have been turned back on at Funtime as of this morning but nobody has yet to answer the phone. I have been trying about every 15~20min. Hopefully they will start answering the phone so that arrangements can be made for pick up of my unit.
Keeping my fingers crossed.

Finally can breath a breath of fresh air. I have the trailer back at the house. Finally got somebody on the phone just before 1pm. So in 4 1/2 hours drove down to Cleburne, 90 miles away, hooked up a returned and still made my 6pm meeting on time.
Scary part was I walk in, tell them who I am, they pull the trailer and send me on my way. Never asked for any ID or proof that it was my trailer in any way. After I hooked up all he did to verify who I was was escort me to the gate so that the guard would let me out.
One poor lady there had no idea what was going on. As I and a few other customers waiting to talk to the only employee there to check out the trailers tried to explain what was going on, she was so shocked all she could ask was if her warranty repairs were completed. I felt bad when I finally told not to worry about if the repairs on done just be grateful to get your trailer and get it off the lot ASAP. You call call the mfgr and work out the warranty repair issues later.
Speaking of Warranty Repair issues that is next on my list. Only 1 of the 4 items the repair list was taken care of. My first year was up at the beginning of March, but Funtime was still working on issues that were identified prior to that date but were still unresolved. So I guess Keystone is my next call. Hopefully we can get these warranty items resolved with another dealer.

It is turning in to a real cluster. I am so glad I was able to retrieve my unit when I did.
Right now no rep from Funtime is on the lot. So any unit in the service dept is stuck. Only units owned by GECC or FFC are being allowed off the lot. Neither one will take the responsibility of releasing non-bank owned property.
It is turning in to a real nightmare. There are still several owners who are unaware of what is going on. Right now the rumor is all non-bank owned property is being turned over to the courts. The fear is that it could take weeks if not months for the courts to release the property.

See, I told it would not be good to wait around. Glad you acted promptly, stuck to it, and that you got yours back right away.
There are going to be some very unhappy campers over this before the whole deal is through there.
I can just imagine all of the finger-pointing and passing-of-the-buck that will go on when some poor schmoe gets their trailer back and it's missing that nice 40" HD LCD TV, Microwave, Stereo, etc., etc.
