Jury Duty Summons, New Mexico
We're full-timing and we're not sure how to handle a jury duty summons. We're not in the area and have made and paid for reservations for the foreseeable future that will be in conflict with the summons' dates. As our legal residence is Santa Fe, and Santa Fe is a tourist destination, the rv parks are about $900- $1400/mo+ and availability is limited. Any experience? Any suggestions? As is true with many things, using the correct language can be very helpful in communicating with the authorities the hardships of serving will cause.

I had it happen twice two different years. One time we were workamping in NM and the other at the North Rim Az. I wrote them and let them know that I would lose my job and still had a few months left. Each time they excused me. We have been back in our home State for 8 months and no summons yet. Again we were working so I don't know if that would work if you are just on a vacation or on a visit. my wife said write or call them and explain and they may ask when you plan on being back home and put it off until then.

I called the court clerk and explained that I was traveling and wouldn't be in the area and she removed me from the list

Happened twice, let them know I was out of state and would not return until such and such a time. Was excused both times.

Same here. SD gives you a pass if you tell them you are full-timing and out of state. When the clerk realized we were with Alternative Resources, she immediately understood our situation.

That's the nice thing about SD. We are permanently listed as nomads, and don't get jury summons, and we are with Americas Mailbox.

Since they know us here they pull us before they send it, but if we are in the area they also know and we will go. If you call and let them know that you are not close by they should excuse you.

Hey, gang, thanks to each of you who responded to our request for advice on handling jury duty. Our dilemma, in part, is that we really care about our community. We never ignore an election, and we see jury duty as being a part of being involved, active citizens. And we still own a stick house in Santa Fe to which we will return once we leave the road. The downside of serving just now, as we mentioned, is the expense and availability of rv parks in the summer anywhere near home. Our local municipal court has prospective jurors on call for a three month period at a time, and a person may serve once or many times, dependent. Also, we're staying around New Mexico just now, in order to be available for appointments at the VA in Albuquerque that come up with a day or so notice, as we have been dealing with Mike's health. It looks like the best we can hope for is a deferment, and that will work all-round for us. Thanks again! Is there anything anybody can ask on this board that someone hasn't experienced? That's the beauty of this forum.

just write the court and explain that you are not in the area. just explain it and there shouldn't be any problem. it isn't a big deal, courts do it all of the time.

Is it magistrate, district, or grand jury? In NM it does make a big difference.

Jury Duty
Most courts will excuse anyone over 65 years old from jury duty.

For my last jury duty I filled out the form and told them I was in Az for the winter and if they really want me they could send a plane ticket and I would gladly appear. I was excused until summer session. I am now 70 and have opted out of the jury pool.

Thanks for the info, we had our mail sent to us and I received a jury summons today after reading this yesterday. I called and explained our situation being full time and in California and it was dropped.

state: hang them as they are guilty...whats the charge?
not really. but good to read here there are ways to atend to this. as i am still working. it would be a hardship on me to just pay my bills. but that would not get me out of it.
at 58 only once did i even have to show up at the court house. not picked. but lost a days pay. it was a small company ( 5 drivers so put even my employer in a bind. ( truck driver).
where i work now. we have over 100 drivers so no problem there.
one must do there duty as possable. but it should never place any in a hurt to do so.
